General terms and conditions of sale

Between the company Wissew, registered with the Trade and Companies Regime of PARIS under the SIRET number 830 912 820 00016
 On the one hand, And the previous natural or legal person to the purchase of products from the company Wissew. Hereafter, the "Buyer", or the "Customer" On the other hand, AFTER HAVING BEEN EXPOSED THAT: The company Wissew, publisher of the e-commerce platform https://www.wissew.com, sells sewing pattern designers' patterns to potential buyers. 
IT WAS SET OUT AND AGREED AS FOLLOWS: 
Article 1 - Acceptance of conditions 
The present conditions govern the contractual relations between Wissew and its client, both parties accepting them without reservation. In particular, they lay down the rules for the sale and use of patterns sold for exclusively individual and private use by the customers who have acquired them. The customer therefore declares that the use of the products sold by Wissew is unrelated to his professional activity.
Prior to his order, the customer is therefore invited to consult the present general conditions of sale. He acknowledges having read and understood them and declares that he accepts them unreservedly. 
The general terms and conditions of sale may be subject to change without notice. However, it is understood that the general conditions of sale appearing on the site on the day of the order will be the only conditions applicable to the customer at that time.
 
Article 2 - Product characteristics 
The items offered for sale are those that appear on the site on the day the customer consults it. 
Wissew endeavours to give as much detail as possible on the models presented so that the customer can know all the characteristics as well as possible before ordering.
The photos of the articles on the site are non-contractual. In the case of a sewing pattern, it is highlighted by means of a creation from the same pattern. This creation, which is as faithful as possible, offers an example of look and material, but in no way reflects what the customer can do with it according to his level of sewing, his tastes or his desires.
Wissew can therefore in no case be held responsible for a difference between the visual of the creation resulting from the article ordered (the pattern) and the personal realization that the client will make of it after use and confection.
 
Article 3 - Tariffs 
The prices shown on the site are in EUROS - VAT included (VAT not applicable, art. 293B of the General Tax Code). They are payable in cash via one of the means of payment offered by the site. 
It is understood that the price displayed on the site on the day the order is taken will be the only one applicable to the customer at that time. 
 
Article 4 - Order 
For each new product put on sale, an order link leads directly to the description sheet. Once the payment is made, the order is taken into account and validated. 
The content and date of the order are recorded by the computer systems of the www.wissew.com website. The automatically listed data are considered to be proof of this order.
The Sales Order validated by the client will only be considered effective once the secured bank payment centre (Stripe) has given its approval on the transaction. 
Wissew cannot be held responsible for input errors made by the client at the time of the order (in particular the input of contact details - name, email and postal addresses...) and consequently for delays or delivery failures that these input errors could have caused.
Before any order is taken, the customer must check the capabilities of his computer equipment to read, store, and print digital products and more particularly its capabilities to print the digital product in REAL SIZE. Wissew can thus not be held responsible for a printing scale problem inherent to a defect in the setting of the client's printer.
Wissew reserves the right to refuse or cancel any Sales Order placed by a client, notably in the event of the said client's insolvency, or in the event of the non-payment of the Sales Order in question, or in the event of a preceding delivery, or in the event of a litigation relative to the payment of a preceding Sales Order. 

Article 5 - Method of payment 

The payment is made online, optionally, via direct credit card.

- Credit card (secure): secure payment via the STRIPE platform. The Customer will simply have to enter his credit card data (card number, validity date and pictogram) via the form provided, then validate the payment. The bank data exchanged are entirely managed and encrypted by STRIPE and by the site's SSL certificate. They are, under no circumstances, neither readable nor kept by the site www.ivanne-s.fr.

The order is considered effective once the confirmation email is received at the email address entered by the Customer. 

This confirmation email also contains the INVOICE of your order.

Article 6 - Availability of products 

Digital downloadable products are unlimited in stock. They are therefore available as long as they are offered for sale on the www.wissew.com website. 

Article 7 - Delivery of products 

Downloadable products are delivered to the customer via web links pointing to the corresponding files. The links are available automatically on the order confirmation page as well as via an e-mail message sent to the customer at the e-mail address registered on his account.

In the event of a problem, the customer should make a request to: contact@wissew.fr. 

Article 8 - Withdrawal 

As long as the product has been downloaded at least once, the right of withdrawal does NOT apply in the case of digital products that can be downloaded from the website. 

Article 9 - Liability 

Wissew cannot be held responsible for damages of any kind, whether material, immaterial or corporal, which could result from the misuse of the marketed products. 

The liability of Wissew will be limited to the amount of the order. In case of difficulties in the application of the present contract, the client and Wissew reserve the possibility to seek an amicable solution before any legal action. 

Article 10 - Warranty 

In all cases, Wissew cannot be held responsible for the misuse of the products by the client, but also for the non-respect of the regulatory provisions in force in the country of reception. 

Article 11 - Protection of personal data/privacy 

All bank data is encrypted. None of them are communicated to Wissew who has no knowledge of them. 

The personal information collected for distance selling is mandatory because it is essential for processing orders. Failure to provide this information will result in the non-validation of the order.

All the personal data of the customers will be used only to treat the orders, they will remain strictly confidential. 

Wissew commits itself never to divulge, either free of charge or with compensation, the contact details of its clients to a third party.

In accordance with the law "Informatique et Libertés", the processing of personal information relating to customers has been declared to the Commission Nationale de l'Informatique et des Libertés (CNIL). 

In accordance with the law n° 78-17 of January 6, 1978), the customer has a right of access, modification, correction and deletion of the data communicated. To exercise this right, the customer must contact IVANNE.S directly: contact@wissew.fr. 

Article 12 - Intellectual property 

Any commercial use of the patterns is FORBIDDEN.

By extension, the sale of clothing sewn from patterns purchased on Wissew is also FORBIDDEN.

All the texts, illustrations and images reproduced on the https://www.wissew.fr website are reserved under copyright as well as under the intellectual property rights of the sellers. 

Article 13 - Terms and conditions of use of patterns 

Any reproduction, and in particular printing on paper or digital duplication, must remain within the strict legal framework of private copying. 

The distribution, resale, copying, lending in libraries, transfer, exchange, or any free or paid diffusion of the digital patterns sold on Wissew (in whole or in part) are strictly PROHIBITED, whatever the medium (electronic or printed).

Buying a Wissew e-patron is not only to acquire a model to sew and to be declined ad infinitum, but it is also to encourage and respect the work of the independent creator who has passed from the

time to realize it with care in order to give them the taste and pleasure of sewing, to catalyze their ideas and to awaken their creative potential.

Far beyond intellectual property laws, it is also a question of morality and honesty. Thank you for respecting the creators of Wissew by not endorsing free sharing (between friends and on social networks). Likewise, please do not encourage any other form of unauthorized distribution (acquisition other than through https://www.wissew.com). 

Article 14 - Litigation 

The present general conditions of sale are subject to French law. 

Any dispute between the company and the customer will be submitted to the competent court. 

The language of this contract is the French language. In case of translation, only the French version is authentic.Â
