TERMS AND CONDITIONS OF SALE


The Wissew website(www.wissew.com) is the property of WSW, registered with the Nanterre Trade and Companies Registry under number 952 378 503 and with a share capital of €1000, as well as all related rights (hereinafter referred to as Wissew).

1. Acceptance of terms and conditions

The present general terms and conditions of sale aim to define the contractual relations between Wissew and any non-trading and non-professional individual wishing to make a purchase on the Website. Wissew reserves the right to modify the General Terms and Conditions at any time. They will then be applicable as soon as they are put online. Before placing an order, the Customer must accept the General Terms and Conditions of Sale.

2. Characteristics of the goods offered

Wissew sells sewing patterns and not finished garments or fabrics. The essential characteristics of the Products are described and presented on the site as accurately as possible.

2.1) Sewing patterns or other intangible goods

The patterns offered on the Wissew website are those of fashion designers. As these are sewing patterns and not finished products, the photographs that appear on the site are those of creations made on the basis of the pattern and the description either by the pattern creator himself or by customers of the Wissew site who have purchased the pattern. Wissew is therefore not responsible for any difference between the visual of the pattern and the personal realization of the Customer after the use of the pattern and the making of his garment. They are offered without stock limit. They are therefore available as long as they are offered for sale on the site.

2.2) Fabrics or other material goods

The photographs of fabrics are as accurate as possible, but cannot guarantee perfect similarity with the product offered, particularly as regards colors. They are offered while stocks last.

3. Prices

The prices of Products (tangible or intangible) are indicated in Euros, all taxes included. They take into account any discounts applicable on the date of the order. If one or more taxes or contributions, in particular environmental taxes, are created or modified, either upwards or downwards, this change may be passed on to the sale price of the Products displayed on the Internet Site and on the various sales media. For material goods (fabrics), Product prices do not include delivery charges (postage, packaging and parcel preparation according to the amounts in force). The amount of delivery charges will be specified before the order is confirmed.

4. Order

To place an order, you must either:
- use your Wissew account by logging in with your email address and password.
- place an order as a "guest", i.e. without first creating an account. In this case, you must enter your title, surname, first name and e-mail address.

Once you have validated your basket, and validated your payment method, this last step formalises the sales contract with Wissew. All orders imply acceptance of the prices and descriptions of the Products. The validated order is considered effective only when the secure bank payment center (Stripe) has received the payment. The order is considered effective once the confirmation email has been received at the email address entered by the Customer. The Customer will receive an invoice by e-mail. When the order is validated, the content and date of the order are recorded by the www.wissew.com website. Wissew cannot be held responsible for any input errors made by the Customer during the order process. If you have any questions about tracking an order, please contact contact@wissew.fr.

5. Terms of payment

By credit card: Carte Bleue, e-carte bleue, Visa, Mastercard, American Express and GPay. Payment is secured via the Stripe platform. Customers must enter their credit card details (card number, expiry date and pictogram) on the form provided, then confirm payment. Bank details exchanged are fully managed and encrypted by Stripe and by the site's ssl certificate. Under no circumstances is it readable or stored by Wissew. In case of out of stock or unavailable Products, the amount of these Products will not be debited.

6. Delivery of goods

6.1) For material goods (fabric)

Material goods can be delivered in mainland France via:
- Chronopost " (4 to 5 days from validation of your order)
- Relais Colis (4 to 6 days from validation of your order)
- Mondial Relay (4 to 5 days from order confirmation)
- Colissimo (2 to 3 days from validation of your order).

Physical goods can also be delivered outside mainland France, in particular via :
- Delivengo (5 to 6 days) in Germany, Belgium, Spain, Canada, USA and UK.
- Mondial Relay Europe (5 to 6 days) for Belgium and Spain.
- Colissimo (7 to 9 days) for Guadeloupe, Reunion and Martinique.

The delivery times indicated below are not guaranteed. Wissew reserves the right to use service providers other than those mentioned above for information purposes only.

Any delays do not entitle the customer to claim damages. Goods always travel at the recipient's risk.

For Chronopost, Relais colis and Mondial relay deliveries, the recipient receives an electronic message informing him of the availability of his parcel at the destination relay point selected at the time of ordering.
In the event of unforeseen closure of the destination relay point, the parcel is sent to the nearest relay point. The recipient receives an e-mail informing him/her of the new location where the parcel will be made available.
The recipient has 7 working days to collect the parcel from the relay point. If the recipient fails to collect the parcel, it is returned to the original delivery address.
As the customer has accepted this method of delivery and has undertaken to collect the parcel, no reimbursement will be made if the parcel is not collected from the collection point.
In order to return the parcel to the addressee, the customer will be charged a re-shipment fee.

6.2) for intangible products (sewing patterns)

The pdf patterns are automatically sent to the Customer by e-mail, immediately after the order has been validated. In the event of a problem, the customer should send a request to: contact@wissew.fr. For all products (material or immaterial), delivery times depend on the type of payment selected by the Customer, and delivery will only take place once payment has been received and cleared by Wissew.

7. Withdrawal

7.1) With regard to sewing patterns or any other intangible goods :

Due to the nature of the Service of downloading digital Products, i.e. immaterial services delivered solely by downloading, and whose execution has begun with the Customer's agreement before the end of the withdrawal period, the Customer may not exercise his right of withdrawal concerning the purchase of these Products, in accordance with the provisions of article L.121-20-2 of the French Consumer Code.

Any sewing pattern or any other immaterial good ordered several times by the Customer may not be reimbursed

7.2) With regard to fabrics or other material goods :

You have a right ofwithdrawalof fourteen (14) calendar days from the date of receipt of your order. During this period, you may return undamaged Products without having to justify your reasons or pay any penalty. To exercise your right of withdrawal, simply send an unambiguous e-mail indicating your intention to return the Product to the following address: contact@wissew.com . Returned Products must be intact and complete, and must not have been sent with extended postage. Wissew will acknowledge receipt of your retraction by email. You must then return the Products to Wissew, at the latest within fourteen (14) days following the date of your retraction, by post to the following address: WSW - 2 Boulevard Saint Denis, 92400 Wissew. Wissew undertakes to reimburse you for all sums paid upon receipt of the Product. Wissew will reimburse you for returned Products, subject to compliance with the above-mentioned conditions. Refunds will be made via the payment method used for the returned order. However, the cost of shipping and reshipment of the product remains at the customer's expense.

8. Prices and invoices

The prices shown on the website are in euros and include the applicable VAT. Wissew reserves the right to modify its prices at any time, it being understood however that the price appearing on the site on the day of the order will be the only applicable one.

A buyer may request proof of purchase after completing an order on Wissew. In response to this request, Wissew will send a receipt of payment by e-mail to all buyers who request it. As a resale platform, Wissew is unable to provide an invoice for orders placed. If the buyer wishes to obtain an invoice, Wissew will request this document from the sellers of the patterns ordered. Sellers have 15 days to send the invoice to the buyer.


9. General information on data protection

The personal information collected for the purposes of distance selling is compulsory, as this information is essential for the processing and routing of orders, the preparation of invoices and warranty contracts. Failure to provide this information will result in non-validation of the order.

In accordance with the French Data Protection Act (Loi Informatique et Libertés), the processing of nominative customer data has been declared to the French Data Protection Authority (Commission Nationale de l'Informatique et des Libertés - CNIL). The customer has the right to access, modify, rectify and delete data concerning him/her (article 34 of the law of January 6, 1978), which he/she can exercise by contacting Wissew: contact@wissew.fr. In addition, Wissew undertakes not to communicate, either free of charge or in exchange for payment, the contact details of its customers to a third party.

Wissew will archive order forms and invoices on a reliable and durable medium constituting a faithful copy in accordance with the provisions of Article 1348 of the French Civil Code. The seller's computerized records will be considered by the parties as proof of communications, orders, payments and transactions between the parties.

In accordance with the provisions of the French Data Protection Act, Wissew informs its customers of their right to access and rectify personal data and of the absence of any right of opposition concerning the creation of their account and the questionnaire they fill out.


10. Procedure for downloading intangible products


Wissew will send the sewing pattern by e-mail as an attachment. The Customer must have a compatible computer with software installed to read or print the documents. Therefore, before ordering, the Customer must make sure that he can print the pdf patterns, he must have a printer to print in A4 format in real size (100%). Wissew is not responsible for scaling problems. Customers will find a printing guide in their folder.

If for any reason the Customer is unable to download the Product, or is unable to open, read or print the file corresponding to the Product, he may contact Customer Service at the following address: contact@wissew.fr.



11. Intellectual property of intangible products

The Products downloaded by the Customer are digital files protected by national and international copyright and related rights provisions. Under these conditions, Wissew grants the Customer a personal and non-transferable right to use the Products, strictly limited to viewing and printing the Products for the Customer's exclusive use. Under these conditions, the Customer undertakes not to reproduce, summarize, modify, alter or redistribute the Products without the express prior authorization of Wissew, which excludes all operations of transfer, resale, rental, exchange, and making available to third parties by any means. Furthermore, the sale of garments made with patterns purchased from Wissew is prohibited.

12. Disputes

The present general terms and conditions of sale are subject to French law.
Any dispute between the company and the customer will be submitted to the competent court.
The language of the present contract is French. In the event of translation, the French version shall prevail.
